Our process is non-intrusive.

 

We only need your electronic importation data and may need access to you electronic parts/items catalog. Within weeks we will provide you with the report for your approval before the refund claims are sent to Customs.

Tariff Classification:

 

Imported goods must be classified accurately and assigned the correct tariff classification number (HS Number). The description, use and contents of the imported material determine the tariff classification.

 

Valuation:

Elements of the price paid or payable to the vendor, although not defined in law,  must be taken into consideration when determining the price paid or payable.

These elements may include but are not limited to:  direct payments; indirect payments; invoice price; price escalation clauses; export duties and taxes; warranty payments; storage charges; quota payments; interest for deferred payments; and/or discounts.

Legislated adjustments to the price paid or payable are provided for under Subsection 48(5) of the Customs Act.  Each of the adjustments (additions to and deductions from the price paid or payable) and the criteria used to determine its dutiable status will be determined.

 

Transfer pricing:

For customs purposes, reductions in the price paid or payable by the importer to the foreign vendor may be allowed. Paragraph 48(5)(c) of the Customs Act provides that the price paid or payable in the sale for export to Canada shall be adjusted "by disregarding any rebate of, or other decrease in, the price paid or payable for the goods that is effected after the goods are imported".  

 

Origin/Trade Agreements:

The country of origin or country of manufacture is determined by the place where the goods were "substantially transformed."

Trade Agreements affect the tariffs and the import duties paid on goods. Preferential tariff treatment is used on eligible goods that may be imported duty free or under reduced customs duty rate.

Duty Drawback:

You may be entitled to hundreds or thousands of dollars in duty drawback refunds and not even know it.

A drawback is a refund, in whole or in part, of the customs duties collected upon the importation of materials that are later exported unused or as a finished good. Drawback is driven by exports. Efforts should begin here and move backward to identify duty-paid components used in manufacture, or product on which duty was paid upon import and is then exported by you or any other company.
